As of November 9, 2016, Prop 64 legalized the nonmedical (recreational) use of cannabis by persons 21 years of age and over, and the personal cultivation of up to six (6) cannabis plants indoors for personal use. Prop 64 requires a State license to engage in commercial cannabis activities and licensing authorities are required to begin issuing licenses by January 1, 2018. The State has recently issued over 100 pages of regulations for the medical and nonmedical cannabis industry. These regulations will apply in addition to regulations the City may adopt. State law allows the City to collect specific taxes on cannabis operations and sales of nonmedical cannabis. To do this, Benicia voters would have to vote in favor of specific tax rates. If authorized by the City Council, such a measure would be presented to the voters in 2018.
