To our knowledge, there is not truth to that claim. There are a few undeveloped lots on Cahaba Heights Road (3304-3328) that are zoned for residential use but, at this time, there have not been a permit requests submitted to the City for land disturbance (clearing the land) or construction. Also, there are no current pans to widen that portion of the roadway. If you have any additional questions regarding the land or the roadway, feel free to submit your question here on the Grapevine or call City Hall at 205.978.0100 and ask to speak to someone in Engineering or Building Services. The City staff is happy to answer any questions you may have.

City staff were made aware of the Cambridge Circle project earlier this week and immediately contacted the developer to require compliance with our Land Disturbing Permit requirements. Once the City was made aware, the only work being performed is that which allows the developer the ability to institute erosion control measures. Therefore, the ability to remove additional brush, etc. so that erosion control measures may be implemented is the only work that has been allowed to continue.

The developer has applied for a permit and issuance was completed this afternoon. For specific information regarding penalties for an unresolved disturbance please see Ordinance 2769, available on the City website at https://vhal.org/wp-content/uploads/sites/120/2018/07/Ordinance-2769-Erosion-Sediment-Control.pdf.

The stormwater pipe issue has been discussed with the developer. The erosion of the pipe is pre-existing, but the developer is addressing the issue and will stabilize the pipe. Under the guidelines of our Stormwater Management Program, City Engineering staff will closely monitor the repair/stabilization of the pipe.

In December of 2018, the City Council adopted and approved Ordinance Number 2814 to regulate this new technology. The only reference to height states that the antenna “shall extend no more than five (5) feet above the height of that structure; provided that, in the event that the applicant demonstrates that National Electric Safety Code regulations or other factors create an undue hardship in complying with this height requirement, the City Manager may permit a facility to extend up to ten (10) feet above the height of such support structure.” Any new structures require a permit application that will be reviewed for approval by the City Council and, as such, height would be addressed on an individual basis.
