What are your comments and feedback on the City of Vallejo considering amendments to the Sidewalk Ordinance?
Property owners in Vallejo already have an obligation to maintain the sidewalks abutting their property in good condition under two separate, but related laws:
California Streets and Highways Code Section 5610 and Vallejo Municipal Code section 10.04.320. These statutes have applied to Vallejo property owners since 1941 and 1957 respectively.
Our current local ordinance (enacted in 1957) requires the public works director to send a notice to the property owner whenever the sidewalk abutting the property owner’s property is in disrepair. The property owner must repair the sidewalk. If the property owner does not repair the sidewalk, the public works director may undertake the repair and file a lien against the property owner so that the City recovers the costs of the repair.
The proposed ordinance accomplishes the following:
- Noticing by the public works director is allowed but not required. All property owners are held to be responsible for knowing the condition of their abutting sidewalk.
- It provides a ‘no-fee’ permit for repairs to sidewalks damaged by street trees.
- It provides for a reduced fee of $200 for ‘minor sidewalk repair’ permits.
- Owners will owe a duty to the public to maintain a safe place to walk where there is a sidewalk. The Public will be assured that it will have a safe place to walk where there is a sidewalk.
